Good News for Vietnam Vets that Didn't Have "Boots on the Ground"

On January 29th of this year, the Court of Appeals decided that Vietnam Navy veterans would be given the same presumption of service connection for Parkinson's disease and other ailments that Vietnam veterans who had "boots on the ground" are given (which mainly encompasses Army and Marines). Most Navy veterans served on ships off the shore of Vietnam, and from the the VA has followed a policy of deciding that such veterans did not serve "in country" to be given the service connection presumption for Disability Compensation Benefits. As of the January 29th, the Court of Appeals overturned that policy.

  While this is good news, as of a VA memo dated February 15th, the department heads of the VA are directing claims agents not to process any claims while the VA makes a motion to stay the implementation of the Court's opinion. This reasoning comes from the VA  being in the process of deciding whether to appeal to the Supreme Court or not.
